The activism of institutional investors tends more and more toward the supervision and control of the behavior of the managers of big companies. In this article, we present a model based on the creation of an activism index that lets us evaluate such activism's effect on the sensitivity of the investment policies of a company in the face of financial variables and market variables. To test our assertions, we analyze firm-level data for United Kingdom, Germany, France, Denmark, and Spain during (...) the period 1995-2004. Our results point to a significant reduction in the sensitivity of company investment decisions in the face of these variables, especially relative to intangible capital, as a result of the neutralizing effect of activism on the high agency costs of free cash flow and on the information asymmetries of the market. Nature Network Groups hosted an invited workshop on 'Theories of Consciousness' during the second semester of 2009. There were presentations by each of 15 authors active in the field, followed by debate with other presenters and invitees. A week was allocated to each of the theories proposed; general discussion threads were also opened from time to time, as seemed appropriate. We offer here an account of the principal outcomes. Numerous eukaryotic DNA processing enzymes, such as DNA polymerases and ligases, bind the processivity factor PCNA, which acts as a platform to recruit and regulate the binding of enzymes to their DNA substrate. Multiple PCNA‐interacting motifs (PIPs) are present in these enzymes, but their individual structural and functional role has been a matter of debate. Recent cryo‐EM reconstructions of high‐fidelity DNA polymerase Pol δ (Pol δ), translesion synthesis DNA polymerase κ (Pol κ) and Ligase 1 (Lig1) bound to a DNA (...) substrate and PCNA demonstrate that the critical interaction with PCNA involves the internal PIP proximal to the catalytic domain. The ancillary PIPs, located in long disordered regions, are instead invisible in the reconstructions, and appear to function as flexible tethers when the enzymes fall off the DNA. In this review, we discuss the recent structural advancements and propose a functional hierarchy for the PIPs in Pol δ, Pol κ, and Lig1. (shrink)

Jewish law has a history stretching from the early period to the modern State of Israel, encompassing the Talmud, Geonic and later codifications, the Spanish Golden Age, medieval and modern responsa, the Holocaust and modern reforms. Fifteen distinct periods are separately studied in this volume, each one by a leading specialist, and the emphasis throughout is on the development of the institutions and sources of the law.

The distribution pattern of the meiotic machinery in known eukaryotes is most parsimoniously explained by the hypothesis that all eukaryotes are ancestrally sexual. However, this assumption is questioned by preliminary results, in culture conditions. These suggested that Acanthamoeba, an organism considered to be largely asexual, constitutively expresses meiosis genes nevertheless—at least in the lab. This apparent disconnect between the “meiosis toolkit” and sexual processes in Acanthamoeba led to the conclusion that the eukaryotic ancestor is asexual. In this review, the “meiosis (...) toolkit” is rigorously defended, drawing on numerous research articles. Additionally, the claim of constitutive meiotic gene expression is probed in Acanthamoeba via the same transcriptomics data. The results show that the expression of the meiotic machinery is not constitutive in Acanthamoeba as claimed before. Furthermore, it is argued that this would have no implications for understanding the nature of the eukaryotic ancestor, regardless of the result. (shrink)

Husserl on the Ego and its Eidos (Cartesian Meditations, IV) ALFREDO FERRARIN THE THEORY OF the intentionality of consciousness is essential for Husserl's philosophy, and in particular for his mature theory of the ego. But it runs into serious difficulties when it has to account for consciousness's transcendental constitution of its own reflective experience and its relation to immanent time. This intricate knot, the inseparability of time and constitution, is most visibly displayed in Husserl's writings from the 192os up (...) to the notion of the eidos ego in the fourth Cartesian Meditation. In this paper I want to dwell on the most problematic aspects of this theory. After a few preliminary remarks about the intentionality of consciousness (sec- tion 1), I try to place the theory of the substrate of habitualities in the context of Husserl's evolution on the issue of the reflection of the ego on itself (section ~). But what the secondary literature does not do is develop thematically the ambiguities of Husserl's definitions of consciousness and temporality in a unitary and comprehensive way. While I follow the lead of Berger, Broekman, Kern, Marbach,' and others, I find that their work does not sufficiently stress the difficulties at the core ofintentionality and reflective time- consciousness. Therefore, although section 2 is a necessary presupposition for drawing some critical conclusions in the final two sections, it does not exhaust my theme. After clarifying the peculiarity of the notions of essence, intuition, tran- scendental and apriori, as well as their irl:educibility to a Kantian meaning, I turn to the "de facto transcendental ego" resulting from eidetic variation (section 3) in order to introduce an examination of temporality. The difficul- ties in the twofold requirement, namely, that consciousness be the identical subject of its Erlebnisse and be synthetically unified in time, concern the unity, primacy, and mutual relation of time and consciousness in the constitution of our experience. They have been heady pointed out by Ricoeur in his commen- tary on the Cartesian Meditations. But what I want to argue in section 4, going beyond Ricoeur's text, is that the tension between temporally constituted and constitutive consciousness in the ego's reflection on its own retentions and protensions does not simply make the question of time ambiguous, but has crucial and problematic bearings on the very definition of consciousness as intentionality. The importance of Adam Ferguson as part of the Scottish Enlightenment has been well established, with concentration on his social and political thought. George Turnbull has not been as well studied, but the valuable recent anthology by M. A. Stewart and Paul Wood has incited new interest. This paper selects a narrow aspect of their thought, their views on the social role of knowledge, which show common as well as complementary aspects. As educators who published their enhanced class notes, their (...) concern for providing positive motivations for their students is evident from their writings. Moral philosophy courses in general attempted to prepare graduates to assume responsible roles in society. Turnbull emphasizes the inspirational value of order and beauty in nature, while Ferguson's particular interest is in the value of learning efforts and knowledge development as part of the cumulative progress of civilization. We believe that a joint review of their thought can provide a rich source of possibly inspirational and motivational themes that could be helpful for professionals and educators in any culture. These topics are discussed here in the broader context of the Scottish Enlightenment. (shrink)

XIX español, el autor analizó los casos de importantes intelectuales como Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus y Nicolás Serrano. Con ello se cumplió parte del plan de desmontar la tesis frecuentemente aceptada de una "ausencia" de Vico en España. Este plan se viene a desarrollar ahora con una nueva aportación investigadora en la que el autor muestra y analiza (...) tres importantes casos más de recepción viquiana: la del ecléctico historiador Fermin Gonzalo Morón, la del renovador neoescolástico Ceferino González, y la del fundador de la escuela jurídica catalana Manuel Durán y Bas. Con ellos el autor confirma su tesis de que Vico es apreciado, tanto desde la recepción positiva como desde la crítica, como un pensador modemo y heterodoxo de considerable valía.In his former paper on Vico’s reception during the XIX century in Spain, the author reviewed such significant intellectuals as Juan Donoso Cortés, Jaime Luciano Balmes, Juan Valera, Marcelino Menéndez Pelayo, Alfredo Adolfo Camus and Nicolás Serrano. In so doing, the task of dislodging the thesis so frequently held that there is a Vico’s "absence" in Spain was partially accomplished. This task is taken up again in a recent investigation where the author analyzes and assesses three further important cases related with the Spanish Vichian reception: that of eclectic historian Femín Gonzalo Morón, the neo-scholastic Ceferino González and finally the Catalan legal school founder Manuel Durán y Bas. El transhumanismo es una moda intelectual que propone la transformación de los seres humanos mediante diversas tecnologías. Expondremos brevemente los rasgos más conspicuos del TH, así como las principales críticas que se le han hecho. Pero la intención de este artículo no es entrar en esta polémica; aportaremos tan solo las claves imprescindibles para poder seguir adelante. Y una de las claves más intrigantes del TH es que, por debajo de su pátina tecno-futurista, remite a ciertas ideas filosóficas tan viejas (...) como, en apariencia, incompatibles entre sí. El TH remite al naturalismo radical, tanto como al nihilismo existencialista. La tesis que aquí se defiende es que tanto el naturalismo radical como el nihilismo existencialista son producto de las diversas oleadas del dualismo: del dualismo platónico antiguo, del dualismo cartesiano moderno. Una vez que separamos, a la manera dualista, la libertad por un lado y la naturaleza por el otro, podemos contar hasta dos, como hacen los dualistas, o quedarnos solo en uno, como hacen los existencialistas, que se paran en la libertad, y los naturalistas, que solo cuentan con la naturaleza. En cualquier caso, la imagen del ser humano, que es libertad y naturaleza, sale dañada. Asoma entonces el animal aporético y enfermizo al cual hay que salvar… de sí mismo. ¿Cómo? Siguiendo el método de Procusto, pero ahora con los prefijos bio e info en lugar de sierra y martillo. Hasta que el pobre ser humano encaje en el lecho de la utopía que algunos visionarios han urdido. ¿Y no hay otra vía, otra forma de mejorar la vida humana que sea más respetuosa para con la humana envergadura? Quizá sí, mas para trazar esa tercera vía, entre el naturalismo radical que mutila y el nihilismo existencialista que descoyunta y estira, habría que negar de antemano el dualismo que a los dos engendra, y atenerse a la sensatez común, en línea con la tradición aristotélica, antes que a las ensoñaciones utópicas. En nuestra opinión, el concepto aristotélico de naturaleza humana nos habilita para juzgar las antropotecnias mejor que la normatividad extraída de las visiones futuristas propias del TH. (shrink)

Early in his Essays on Intellectual Powers, Reid draws a distinction between mental power, mental operation, and mental capacity (EIP 21). To the untrained eye, these terms could probably be used interchangeably, and Reid believes this is correct, up to a point. He argues that, if we are interested in understanding exactly how the human mind works, we must use these terms with more precise meanings. This is part of his more general strategy of trying to always use the words (...) with their common meanings, as much as possible, but also pointing out that certain philosophical distinctions are needed to carry out the project of laying out the foundations of the science of the mind. This paper explains what the distinction between power, operation, and capacity is, according to Reid, with the goal of understanding why it is important to draw such a distinction, not only for the Reidian project, but for action theory, more generally. For the theorists of crisis, the revolutionary state comes into existence through violence, and due to its inability to provide an authoritative katechon (restrainer) against internal and external violence, it perpetuates violence until it self-destructs. Writing during extreme economic depression and growing social and political violence, the crisis theorists––Joseph de Maistre, Juan Donoso Cortés, and Carl Schmitt––each sought to blame the chaos of their time upon the Janus-faced postrevolutionary ideals of liberalism and socialism by urging a return to pre-revolutionary moral (...) and religious values. They are united by three counterrevolutionary principles, all of which are purported to remedy revolutionary violence: traditional constitutional fidelity, the philosophy of the decision, and opposition to bourgeois liberalism. This essay is followed by the first complete English translation and publication of Donoso’s letter of October 24, 1851, which contains Donoso’s only reference to the “discussing class,” a political entity later popularized by Schmitt in his 1922 work Political Theology. El tema de las relaciones entre ciencia y religión es central en la obra de Ruse. No se trata de una mera curiosidad o de una cuestión tratada tangencialmente, sino que está en el corazón de sus preocupaciones intelectuales e incluso vitales (sección 1). Hay que señalar, además, que la actividad de Ruse coincide con una cierta encrucijada histórica, en la cual se enfrentan dos posiciones extremas y mutuamente hostiles, el creacionismo, por una parte, y el nuevo ateísmo, por otra (...) (sección 2). Para entender las propuestas respetuosas, matizadas y constructivas que hace Ruse, hay que situarlas en un marco teórico complejo, donde sean posibles actitudes menos burdas que el simple enfrentamiento (sección 3). Quizá la fórmula que mejor recoge las ideas de Ruse en este dominio sea la de “existencialismo darwinista”, como él mismo propone (sección 4). La ética ambiental nació como justa contestación a los excesos del antropocentrismo. Sin embargo, un énfasis obsesivo en lo ético y en lo ambiental, con el consiguiente olvido de lo antropológico, puede estar dañando la vida humana, la libertad de las personas y la vida en general. Abogamos aquí por la construcción de una ecología humana que vaya más allá y más al fondo que las éticas ambientales al uso. Defendemos que el humanismo es perfectamente compatible con el reconocimiento del (...) valor inherente de todos los seres naturales. Lo hacemos basándonos principalmente en algunas ideas de Hans Jonas, aunque rechazamos su heurística catastrofista. De él retomamos la idea de que existe una responsabilidad moral hacia los demás seres vivos, empezando por los más próximos en el tiempo y en el espacio, y hacia el libre florecimiento de las personas actuales. Con ello, también, se rebaja el peso de lo ético sobre nuestra acción ecológica. Esta ha de atender principalmente a criterios experienciales, antropológicos, científicos y de sentido común. Por último, defendemos que la política, la educación y la comunicación ambiental deben orientarse directamente hacia la libertad y el desarrollo virtuoso de las personas actuales, y no hacia el control de las mismas por culpabilización. El tránsito desde la ética ambiental hacia la ecología humana —concluimos— puede ser beneficioso tanto para las personas como para la naturaleza. (shrink)

En la poesía de Ramón López Velarde es fundamental la presencia del corazón y del alma. Ambos conceptos no son simples y únicos, sino complejos y diversos. Hay un corazón confesional e íntimo, llamado “Corazón de San Agustín”; un corazón como órgano del cuerpo, conocido como “Corazón de Harvey”; y un corazón simbólico, el cual recibe el nombre de “Corazón de León”. En correspondencia con estos elementos, hay un alma individual, perteneciente al sujeto lírico; un Anima mundi, relativa a la (...) belleza del mundo; y un Alma Superior, la cual remite al mundo de las ideas platónicas o arquetípicas. Con base en un enfoque propio de la Mitocrítica, se demuestra la importancia de la presencia del símbolo, del mito y del arquetipo en la poesía de López Velarde. En este artículo se trata de explicar la influencia de algunos novelistas rusos en la vida y obra de Gabriela Mistral, ya que en su existencia artística son nombrados con cierta frecuencia, además de recomendarlos como lectura obligatoria, citándolos para referirse a ellos como ejemplo para la educación y el cambio social. En un primer momento, se describe y analiza la influencia de estos autores, a finales del siglo XIX y principios del XX en Chile, a través de hitos significativos (...) como: el primer encuentro que, gracias a la biblioteca de Bernardo Ossandón, Mistral tuvo con estos en 1904; la recomendación que Mistral hizo a Neruda sobre su lectura en 1920; y algunos escritos posteriores en prosa, entrevista y diarios íntimos donde se refiere a ellos. En un segundo momento, se intenta mostrar cómo algunos novelistas rusos no son solo inspiración literaria para Mistral, sino personas con las que se identifica plenamente, por las coincidencias que observa entre estos y ella misma, en el ámbito de los sufrimientos, dificultades y carencias, que se dan a lo largo de sus vidas. The topic of professionalism has dominated the content of major academic medicine publications during the past decade and continues to do so. The message of this current wave of professionalism is that medical educators need to be more attentive to the moral sensibilities of trainees, to their interpersonal and affective dimensions, and to their social conscience, all to the end of skilled, humanistic physicians. Urgent calls to address professionalism from such groups as the Association of American Medical Colleges, the American (...) Board of Internal Medicine, and the Accreditation Council for Graduate Medical Education, among others. In fact, at the 2004 annual meeting of the AAMC six separate presentations addressed professionalism with such titles as "Evaluating Humanism and Professionalism," Professionalism: Expectation, Education, Evaluation," or "Toward Assessing Professional Behaviors of Medical Students through Peer Observations". Professionalism, then, has become part of the current academic medicine parlance, used by administrators, clinical faculty, residency programs, and professional organizations with an expectation of shared meanings and goals. All of these stakeholders focus on what has become a consistent list of attributes deemed to be the essence of professionalism, which usually include variations on altruism, duty, excellence, honor and integrity, accountability, and respect. In fact, most of the scholarly work to date has been listing, describing, decrying, and measuring/evaluating it. In this collection of essays, we don’t argue with these attributes. Instead, we ask questions of the discourse from which they arise, how the specialized language of academic medicine disciplines has defined, organized, contained, and made seemingly immutable a group of attitudes, values, and behaviors subsumed under the label "professional" or "professionalism." This collection aims to be a critical text, one that questions the profession’s beliefs about the nature of its work and how such beliefs are enacted in medical education, particularly as they fuel the professionalism discourse. In addition, we will scrutinize how the discourse is enacted in both the formal and hidden curriculum, and in the larger medical environment. (shrink)

In this paper I argue that both defence and criticism of the claim that humans act ‘under the guise of the good’ neglects the metaphysical roots of the theory. I begin with an overview of the theory and its modern commentators, with critics noting the apparent possibility of acting against the good, and supporters claiming that such actions are instances of error. These debates reduce the ‘guise of the good’ to a claim about intention and moral action, and in so (...) doing have become divorced from the theory's roots in classical and medieval philosophy. Aristotle and Aquinas’ ‘guise of the good’ is primarily a metaphysical claim resting on the equivalence between actuality and goodness, from which conclusions about moral action are derived. I show the reasoning behind their theory and how it forms the basis for the claims about intention and action at the centre of the modern debate. Finally, I argue that the absence of its original foundation is apparent in recent attacks on the ‘guise of the good’. It is unsurprising that modern action theory and ethics have not always been able to comfortably accommodate the ‘guise of the good’; they are only telling half of the story. (shrink)
